1.2. Buyer
The natural or legal person who, by purchasing a subscription through the Avlu website, becomes a party to this agreement and declares their personal/business information electronically at the time of the order. Hereinafter referred to as the "BUYER".
2. Subject and Scope of the Agreement
The subject of this agreement is to determine, in accordance with the Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, the rights and obligations of the parties in relation to the sale and performance of the SaaS (Software as a Service) subscription, the nature and price of which are specified below, that the BUYER has ordered electronically through the SELLER's website dijitalavlu.com or its panel.dijitalavlu.com subdomain.
3. Essential Characteristics of the Service
The Avlu software provided by the SELLER is a cloud-based SaaS productivity tool that allows individual service professionals to manage their day-to-day operations digitally. Depending on the subscription plan chosen by the BUYER, the service includes the following modules:
- Customer relationship management (CRM)
- Calendar and event management
- Financial record-keeping
- Text-based messaging
- Cloud storage (included / available as an add-on)
- Operational reporting
The scope of modules made available to the BUYER is determined by the selected plan (Start, Plus, Pro). Plan details and current pricing are available on the pricing page.
4. Sale Price
The total sale price including all taxes of the service is the amount displayed on the website and confirmed on the order confirmation screen for the plan and billing period (quarterly / annual) selected by the BUYER at the time of the order. Prices are expressed in Turkish Lira (TRY) with VAT included and may vary by region and currency.
5. Payment
The BUYER pays at the time of the order by credit card via the iyzico payment infrastructure. Card details are not stored by the SELLER; they are processed securely through the PCI-DSS compliant systems of the payment infrastructure provider. For auto-renewing subscriptions, the BUYER's card is used on the renewal date via the payment provider's stored-card system (CIM).
6. Performance
The service is performed immediately in electronic form upon receipt of payment confirmation. After placing the order, the BUYER can access the service at panel.dijitalavlu.com using the panel access details sent by e-mail. No physical delivery is involved.
7. Right of Withdrawal
Pursuant to Article 15(ğ) of the Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, no right of withdrawal exists for contracts concerning services performed immediately in electronic form or intangible goods delivered immediately to the consumer.
Because the service is performed immediately in electronic form upon payment confirmation, no refunds are provided for fees charged. The BUYER may cancel their subscription at any time; upon cancellation, access to the service continues until the end of the currently paid period, and no partial refund is issued for that period.
For further details on withdrawal and cancellation, please refer to the Cancellation Policy page.
8. General Provisions
The BUYER acknowledges and undertakes that they have read and understood the essential characteristics of the service, the sale price, the payment method, the mode of performance and the conditions for exercising the right of withdrawal, and that they have provided the necessary confirmation electronically.
If the SELLER is unable to provide the service on time due to force majeure or extraordinary situations related to transport, service infrastructure or similar circumstances, it will notify the BUYER. In such a case, the BUYER may request cancellation of the order or postponement until the obstacle is removed.
This agreement has been read, accepted and approved by the parties electronically. Disputes arising out of the performance of the agreement are governed by the laws of the Republic of Türkiye; Consumer Arbitration Committees are competent up to the threshold value published by the Ministry of Trade, and the Consumer Courts and Enforcement Offices of İzmir are competent for disputes above that value.
9. Entry Into Force
When the BUYER completes payment for the order placed through the website, they are deemed to have accepted all the terms of this agreement. Before order confirmation, the SELLER is obliged to obtain the BUYER's confirmation that this agreement has been read and accepted on the website.
